Hotelier. Born circa 1819. Married Mary Smith at Richmond in 1848. Had at least two children: Thomas Christie (b. 1850) and Francis Joseph (b. 1852). In July 1848 Smart was charged by the district constable at Jerusalem of removing 36½ rods of post and rail fence. The fence had been:
"erected by the Government for the purpose of making a Road from Jerusalem to the Crown Lands through Mr. Smart's Estate and applied the same to Fence in a paddock, his own property, the Fence was split and put up by the Prisoners of the Jerusalem Station a few months back."1
Smart replied to the surveyor-general regarding the charge on 21st August 1848:
"I beg to state that the fence in question was put up to protect my property from the trespass of the Pass-holders of the Jerusalem Station, and that I was at the expense of a considerable part of it myself. I removed a portion to effect an improvement to the road. I will have to put up an equal quantity otherwise a twenty acre paddock would be considered useless."2
Became licensee of the Lion Inn in 1848. Smart transferred the licence for the Lion Inn to Walter McConnon in November 1853. Smart had moved to Victoria by 1857, as he was granted a license for the Queen's Head in Queen Street, Melbourne, on 30th April 1857.
