BOOKING CONDITIONS These conditions set out the basis upon which the owner accepts bookings for holidays. 1. CONTRACT A contract only comes into existence between the owner and the guest when the owner issues to the guest a written confirmation of booking. Written confirmation may be in hardcopy, fax, or email 2. PAYMENT (a) Initial bookings will be confirmed on receipt by the owner of the appropriate initial payment as detailed on the Booking Form together with a completed Booking Form. However, if the booking is made within 8 weeks of the holiday commencement date, full payment will be required. (b) Balance - The outstanding balance is payable to the owner not less than 8 weeks before departure. 3. TRAVEL INSURANCE Personal Travel and Cancellation Insurance is essential and the owner's only prepared to accept a guest's booking provided that acceptable insurance has been obtained. 4. CANCELLATION For all cancellations the guest risks losing your 50% accommodation deposit. If cancelling within 8 weeks of the holiday start date this applies to the full rental. The guest shall notify the owner in writing immediately either by recorded delivery, fax or email if the reservation is to be cancelled. Upon receipt of the guest's letter of cancellation, the owner will release the property and offer it as available. If the owner is successful in reletting the holiday, the guest will receive a refund of the deposit paid less a charge of AUD$100. 5. ALTERATIONS BY THE GUEST The owner will endeavour to act upon a guest's request for subsequent changes to a booking. Where the guest is prevented from going on the holiday because of serious illness, death, or serious illness of a close family relative, jury service, redundancy or unavoidable work commitments, the guest will be allowed to transfer the booking to another person subject to the following: Firstly, the request must be in writing, received by the owner no later than 14 days before departure and must enclose details of the transferee. Secondly, the transferee must satisfy any conditions which apply to the holiday. Thirdly, the guest or the transferee, before the transfer is effected must pay all costs of the matter. 6. GUEST'S RESPONSIBILITIES Should the guest cause damage to the property or its contents or any third party visiting the property, the guest will be responsible for such damage. Guests are required to take out insurance to provide a degree of personal and public protection liability. The guest is also responsible for leaving the property in a clean and tidy condition. 7. TRAVEL ARRANGEMENTS The guest will receive full travel instructions after payment of the balance of the hire charges. This will include the name and telephone number of the owner's representative for the purpose of collection of the key and accompanying to the house. We ask guests to arrive between 1600hrs and 1900hrs and to depart by 1200hrs on the last day. Arrival outside this time may incur a charge by the owner's representative, payable directly by the guest. 8. WHAT THE RENTAL INCLUDES Apart from the actual rental of the house, the following items are also included: (a) Water, Gas and Electricity. Please note that from time to time there are interruptions to the public water supply in Italy. (b) Linen: Linen is provided. 9. LAW AND JURISDICTION This contract and all matters arising from it are subject to the law of the State of Queensland, Australia and to the exclusive jurisdiction of the Queensland Courts. |
